The last few months have been extremely challenging for H-1B applicants as the Department of Labor iCert program for filing Labor Condition Applications has proven to be deeply flawed. Gone are the days of instant LCA approvals. Now, applications routinely take at least a week to approve and a high percentage of applications are being rejected because of problems with the DOL software. Does anyone know what this means?

On May 14, 2007, we transferred this I485 APPLICATION TO REGISTER PERMANENT RESIDENCE OR TO ADJUST STATUS to our NATIONAL BENEFITS CENTER location for processing and sent you a notice explaining this action. Please follow any instructions on this notice. You will be notified by mail when a decision is made, or if the office needs something from you. If you move while this case is pending, call customer service. We process cases in the order we receive them. You can use our processing dates to estimate when this case will be done. This case has been sent to our NATIONAL BENEFITS CENTER location. Follow the link below to check processing dates. You can also receive automatic e-mail updates as we process your case. Just follow the link below to register.

I am not sure if it was posted before, the immigrant visa fee will go up to $400 from $380 effective January 1, 2008.
Also, Bombay and Madras consulates switched to NVC appointment processing (NVC takes over the scheduling of immigrant visa appointments). Delhi and Calcutta are still standard processing posts, but expect them to be converted in the near future as well.
Chinese, Japanese, Australian and some other (mostly Asian) consulates still follow standard processing, but expect them to be converted in 2008 as well.
They convert consulates without any notice to the public, so always check here before sending in DS-230 and supporting documents:

I am not fully aware of all the benefits of having EAD after filing 485. If you have the knowledge about it could you please list down it in this thread.

as of now it lets the spouse to start working.. & then the not too fancy AC21 portability.. Advanced Parole for trvael outside the US etc..
in terms of GC its just another waiting phase..

On mar 12th I got a query on I-485.
It says.
The Documentation submitted with your application and/or a review of service records indicate that you no longer reside in the same state or geographical location as the underlying form i-140 immigration petitioner and /or job location specified by your intended permanent employer.
There fore submit a currently dated letter from your original form I-140 employer which which address this discrepancy.
I filed my labor and I-140 I was in california, i moved to different state since I filed my 485, till now I am with the same employer.
Any gurus who can suggest me on the query would be greatly appreciated.

Hi,
I received RFE on my 485 for I94 copy. My situation is below
I travelled to Tijuana, Mexico from San Diego by road to request
for new I94 at the US Port of Entry at San Ysidro, Tijuana as my old I94
was issued only until PP expiry date but since i already had a valid I94 on H1B notice, The officer didn't issue a new white I94 card even though i requested for one. Also, The officer took my earlier old white I94 card, so i don't have one with me now though i have a copy
of it. Also USCIS is asking for a detailed explanation as to why new I94 was not issued at POE. please advise on how to respond to this RFE

Do note that AILF does cover people who were eligible to file in July but did not file due to USCIS/DOS revised bulletin.....However, it is unknown at this time what the outcome of the lawsuit would be for July applicants vs eligible but non-applicants as the decision is at the discretion of the Judge.....

I've looked in the forums but haven't been able to find an answer for my question. Here's my situation:
EB3 I-140 pending under "Software Engineer" position. 485 has already been applied.
I would like to start a EB2 PERM for a "Senior Software Engineer" position.
Would this constitute a conflict of interest and jeopardize my EB3 140 resulting in a denial?
PS: The intent is to interfile when applying for EB2 140.

YOu should go ahead and file your response to RFE. I had the same issue with my case when my attorney did not inform me of a RFE. After missing the deadline, I filed my repone through a different attorney explaining the problemand USCIS accepte my response.

yes we came back on new year and flight was very good, nice food and staff was really cooperative. At POE it took us 2 min to get out of immigration and custom check. Officers were polite and nice. We both used AP and no questions were asked. I would highly recommond this flight.

I am currently working for company A under H1B visa. Company B recently bought all of Company A�s Assets. I am still working for Company A (doing clean-up work) but will be laid off shortly (within a month). Company B offered me a similar position.
I read that since Company B bought all the assets and runs a similar business they would be considered as "successor of interest�, therefore, we would not need to file a transfer with USCIS and a simple letter would be sufficient.
How does that work exactly? Can I travel with my old visa and the letter? What happens if later on Company A is dissolved? Cancel the visa?
I think that Company B is ready to sponsor me for the Green Card. I�m not sure that they would be ready to pay for the fees for the transfer AND the green card now. I would really like to start the Green card process as soon as possible since it takes so long. I understand that it might be better to file a transfer to be on the safe side but if I can save some of the fees it would be great.

Ok for a long time I have been thinking about getting enrolled in a Phd program and this year I was hoping I get a chance to chase my dream after having the GC... well it did not work the way I thought/planed and now I want to weigh my options.
here are my details:
EB2 I with PD Sep 2005
Primary Applicant
currently on H1B
I 140 approved early 2006
Approved EAD (till Oct 2010)

So my questions is:
Is there a way I can join a univ as full time research student?
Can I take a leave of absense (ofcourse w/o pay) from my current job to join as a student?
