hi
i have been offered a job at my current research centre where i worked as a student. I want to go back to my home country. The job can be done online and does not require physical presence in the USA. Will i still need an OPT? or can they employ me as an international worker? if they wmploy me as an international consultant then what are the ramifications for teh company? wht is the legal procedure? will they have to pay taxes more etc?
Please help

This is complicated. IF you are a citizen or if your wife has any US.S. citizen parents, she can file I-601 waiver application. But if your wife made unlawful entry , departed the U.S and reentered the U.S, then she is subjected to a permanent bar, and she cannot apply for a waiver for a period of 10 yrs. You need to consult a good attorney.

I really need advise. I am with Company A on H1, they filed my H1 extension 2 months ago (did not get approval yet) and they filed my I-140/485/EAD/AP(180 will be finishing after 90 days) and now I got following RFE on I-140. My lawyer has not replied yet.
Meanwhile the client where I am working has offered me full time position. Can I join this client on H1 and ask my current employer to continue my GC process and send AC21 on H1 after 180 days?
"The Master of Science Degree does not appear to be equivalent to U.S. Master Degree. Do NOT send an additional "education evaluations" that are mere advisory opinion. Submit preponderance of evidence that the beneficiary's bachelor and the master degree is U.S. equivalent based on educational records only"

My husband and I are in a big Dilemma whether to apply for EAD or AP? In the lawyer's note,it says that anyone who is I-140 Beneficiary will not be able to use EAD and AP. Is it true?
We are on our 3 years H1/H4 using I-140 benefits only. What should we do?
Please guide us.
We still have 3 years remaining. Problem - We both have no visa stamping after we got our extentions which why AP is required at this point?
Are there any travel restrictions after we file I-1485 with AP or WITHOUT AP.
Please highlight. Will be very useful for us.

Can I apply for EAD for spouse on the basis of I-140 approval? I can not file I-485 due to retrogression and he is running out of her H1B visa limit.
