USCIS has updated the H-1B cap count. (http://www.uscis.gov/portal/site/uscis/menuitem.5af9bb95919f35e66f614176543f6d1a/?vgnextoid=138b6138f898d010VgnVCM10000048f3d6a1RCR D&vgnextchannel=91919c7755cb9010VgnVCM10000045f3d6a1 RCRD) As of December 8, CIS has received approximately 61,500 cases against the regular (non-Master's) H-1B cap of 65,000. However, since CIS sets aside up to 6,500 of this 65,000 for nationals of Chile and Singapore, it is possible that they will stop accepting other H-1B petitions soon, if not already. We are still filing new petitions, but with fingers crossed that they are not too late. If you need to file, please do so ASAP.

If i have labor and 140 approved with previous employer, can i go back to join them on H1B and continue GC process? Appreciate any advise. The new company is unable to start GC process due to economic conditions and capout date is Sept 2010.

Maybe few visas might get rejected because they would have tried to stay in USA permanently. Yes, you may apply for L1 visa extension using Form I-129, and L Supplement. Extensions of two years at a time may be allowed until you have been in the U.S. for a total of seven years if you are a manager or executive.

Application was sent out on 8/8/07.
Received on 8/9/07.

I got labor cert approve on FEB10 and going to apply I-140 via preium process in Mar 15.
My Laber cert was file on April 09 and I have been paid lower than prevailing wage since the company reduce working hour and aset of company is 0
Year 2008
W2 + Net income tax return of company reach required wage
Year 2009
W2 + ballance sheet reach required wage (but net income tax return for 2009 is not availble yet)
Are they going to ask for 2009 net income tax return in March? if my company going to file tax extension this year and I also afraid that the net income in tax return may be lower than the number in balance sheet this year.
Is it posible that My case would be get approve without any RFE?

yes, just fill out a new I-9, this time indicating that you are going to use your EAD.

one of my friend (EB2@TSC - India PD 2001) didnt see anything happen after the infopass ... YET

ABC News has an interesting piece that discusses the birth tourism controversy and quotes a statistic that actually comes from Lindsey Graham's office. According to the National Center of Health Statistics, just 7,760 mothers report that they live outside the US of more than 4,000,000 births each year. Keep in mind that some of these mothers are actually US citizens who reside abroad but want to have their children in the US. So we're really talking about less than .2% of all births as being this huge problem that suddenly justifies overturning the 14th Amendment.

It's true that Obama is focusing on the economy now, but if we do a massive flower campaign now it will get us press and attention and "loosen" things up, then we can go for a second even bigger flower campaign in the spring and in the summer when the previous flower campaign will still be alive in the public's memory. That way people will say "wait, legals? that's different than illegals, and it sounds serious"
We need to get ourselves noticed! The illegals had Obama on the Hispanic radio show with "Piolin Sotelo" last week. Why aren't we doing anything? We are not cowards, are we? The illegals can but we legals can't?
Let's not stop with the flowers until we're heard. We send this week, then in a couple of months and so forth until they fix the injustice we're in

The Senator Chuck Schumer (D-NY), the Immigration Subcommittee Chairman, told the AP yesterday that he plans on introducing a comprehensive immigration reform bill before Labor Day and then hopes to have a debate on the bill in the fall. Schumer hinted that advocates for highly skilled immigrants are likely to be happier with the bill than those pushing for guest worker reforms for lesser skilled workers and that business and the unions have yet to reach a compromise. On Nov 8th, Senator Lieberman and 18 of his Senate colleagues, wrote to Michael Chertoff (Homeland Security Secretary) to extend 12 months opt to 29 months exercising his authority.
On Nov 11th, NAFSA President Johnson also wrote to Secretary Chertoff to make this change, endorsing above request.

Hi All
I have submitted my Indian passport for renewal at Houston Indian consulate via mail , it�s been close to a month I haven�t heard anything from consulate. I tried calling them up, no one attends the call.
Do you have any idea how can I speed up this process? Does personal visit to Houston consulate will help in speeding this up? Does passport submitted via mail can be handed over to me in person ?
