My local congressman got this reply from USCIS on my AP renewal case. Its been over 90 days and pending? Please help with any advice.

The processing of this case has been delayed. A check of our records establishes that this case is not yet ready for decision, as the required investigation into the applicant background remains open.
Until the background investigation is completed, we cannot move forward on this case. These background checks are required to be completed on all applicants who apply for the immigration benefit they are seeking. We will make every effort to make a decision on this case as soon as the background checks are complete.

how can we monitor the process (the processing dates then become irrelevant)...
This is the big question everyone has..I know processing dates are meant only for crazy..no FIFO,random,IO mercy etc..:(

Can someone get GC’s without reaching the priority dates?
I don’t have much information but I heard the following by mouth. My friend told me that he came to know a person(Indian) who had got his GC without the priority date being current. His prior status was EAD. If it is real, is this a fluke case?
I know many people applied for I485 in 2005 Sep, and PD was also from that year, and got the EAD’s. So do they have priority of getting GC than people who had PD dates prior to 2005 but not filed for I485?

USCIS does not give a damn they are a govt agency that sift through paper very slowly every day. What makes you think they have a conscience and they will suddenly feel bad for you?

The Government Accountability Office has released a new report studying the accuracy of the E-Verify database. According to the report, the number of tentative non-confirmations has decreased by 5% over the last two years, an indicator that the system has more complete records than in the past. A little out of the box thinking. There are some useful ideas here even if there are many practical questions on how the plan would work. For one, is a highest bidder system necessarily the best indicator of which employers are most deserving of securing visas. Should a school system desperate for math teachers lose out on securing a visa just because it has a much more limited budget than a major corporation? I'd suggest perhaps looking at a program like this running as a separate track in the immigration system rather than necessarily replacing what we have. Of course,...

I had started my anual subscribtion this Friday (4/10/09). How long does it take to be admitted into the donors forum? I have sent the email with details that same day itself. I have not yet recieved a reciept or any RFEs. Hope there is no backlog:D:D:D

Have you tried calling their office? From what you say, it been more than a month! Call the TX center and if their answer does not satisfy you, lodge an official complaint with the ombudsman's office.

I am on H1B and planning to go for CP. I have to fill the form DS-230 for this and submit to VSF office.
Currently I am on H1B extension and I don't have visa stamped for this extension on my passport.
In this form DS-230 I need to fill field name "Present Address".
I have following question:
- In this form what should I fill my present address
Indian address
OR
US address.
(what I think: I think when I will submit the forms to VSF I will be in india and at that time i will not have the valid visa to enter USA. So I think I should fill the indian address.)
What do you guys suggest?

My LC application (RIR PD Oct 2003) from company A is pending in P-BEC. My RIR got denied recently in Nov 06 and my company informed me that they are considering to use TR->RIR conversion to upgrade the LC to RIR. Can somebody please tell me the process of TR->RIR converion? How long it takes? Pros. and Cons. ?Any help is greatly appreciated
Meanwhile company B filed an LC (RIR PD March 2005). This is also pending in P-BEC. But the lawyer has not received any case number nor 45 day letter.The lawyer is not giving much information. Can somebody please tell me the process?

If your I-140 is approved then you can renew H1B for 3 years, else it will be in one year increments.
You can continue to keep h1B as long as an underlying GC application is pending.
