With the good news of all numbers current, both I and my wife's dates are current and eligible for filing I485.
1. In my application, can I include my wife as spouse for adjustment of status? And In my wife's application, can I include myself as spouse?
I am trying to do this to make sure if anything goes wrong in any one of our application, I can depend on the other one.
2. If I get an EAD based on my wife's application, can we both switch jobs after 180 days and take advantage of AC21? I read in some forums that I can, but the primary application (my wife) has to work for the same company until we get I485 approved.

Though your feelings are ok, the reality is different.
1. yes there are lot of capbale people through out the world earning less than what an average person earns in US. Why any country should provide visas to them if the country does not gain anything from it. Better to know the supply Vs demand concept.
2. Being a very capable person, you choose to be on H4. US did not force it on you. Everyone has the option of going back to their home country or wait here till they get what they desire. You weigh both the options and decide which suits you better. If you decide to stay on H4 for 4-5 years, then at somepoint for some reason you thought it is better than going back. So be practical.
As someone said, one should feel deserved to get GC and not beg for it. Again I am sorry for your status. My wife with CA and CPA and she is on H4 for 5 years now. I know how frustrating it will be. Worrying will not help much. Accept the reality and think calmly which way you want to go in your life down the line in next 5 years. Take actions now for that which may end up in leaving this counrty or staying with current status until you get GC. You have to make up your mind to live a peaceful life.
This GC process will throw anyone into depression.

I agree. The PD for Oct' Bulletin will probably somewhere in mid-end of 2003 and i don't think it'll ever go back to Current .... So what happens to all the 2006,2007 applications ???

I work for the fortune 500 company, fragomen filed my case very last minute (just a day my 5th year finishes). I do not know why they did like that though the HR initiated my GC long time back. I found many of my friends also had similar issues. They really test your patience. One of my friend's case, they have totaly screwed up by filing last minute.

First off, I don't appreciate your sarcasm @ 2 cents leading to a dollar. Secondly if your leader is going to scream at people who are not attending the meetings, this is only going to drive people away from IV. Unfortunately, as someone who has learnt it the hard way, using aggressive language (especially language which is a negative judgement on people's nature) does not get the work done at the end of the day. Logiclife is not screaming at people for not attending. He is screaming at people, who said they will come and did not show up (in addition they did not inform the person who they RSVPed as to why they did not show up).
If there was a legitimate reason for not showing up, then it is fine. But if it was lethargy, low confidence in the success of the event or some other insignificant reasons, then logiclife's screams apply multiple times.
The public disclosure of "AMMA" as an apology to needhelp is commendable.

Everything else looks correct, except for the above...i would have guessed that there would be a lot more in between Apr 04 and Mar 05 than just 905..?
I share your concern, there were more than 905 in that period, I don't think the DOL data sheets have any data for NOv 04 to MAr 05. I'm not sure of the source of the original post...

Is there anyway we could go about pushing our story in the media? I am sure all of us combined have a a few thousand bachelor's, master's and ph.d. degrees. We are a group of people with highly advanced skill sets and this needs to be advertised. Maybe convincing a few journalists to take up our cause could be an option. Local newspapers, political blogs, radio stations etc. etc.

There are many not so preferred areas in Canada, where there is always a demand. Most people prefer large cities such as Toronto, Calgary, Edmonton, Vancouver, etc. These are mostly saturated, but with persistence you should find something even there. If you don't care where you live, you should definitely find a lot of openings in the area you mentioned.

why didnt ur friend apply for MBA in canada?....i think a lot of people have misconceptions and pre-conceived notions about canada.......they think of US as the best and canada does not even figure in their list of options......i have got fooled once into h1b to US unaware of the broken immigration system.......wont happen again......i believe the ones in US on h1b visa from india should spread the word about the pathetic EB 2/EB3 india scenario so that no one else gets lured into US by h1b candy

buddy I dont know if you watched chris matthews last night interviewing many dems who won. Several mentioned immigration reform as part of their mandate
I watched msnbc throughout and every dem interviewed mentioned immigration reform. I do not think in public speeches Nancy and Hillary mentioned imm.
The thing is with the new majority, we should see some activity on imm as a whole.

OP - I honestly feel very sorry for all the people out there who are stuck at PBEC... Its the most unfortunate thing in the whole GC process. And I truly believe that IV Core should treat labor backlog issue as one of their top priority items.
I had filed 2 labor apps in 2004. One from NJ in Jun 2004 and other one from IL in Nov. 2004.. I consider myself lucky to get my IL labor approval. Dont know the status of NJ labor.. I think it might be stuck in backlog too!

Now, the bad part ... the achilles heel of every high-skills amendment is the tethered H1B quota tricks. They are exempting everyone who has US masters or a non-US master in STEM from H1 quota, effectively making H1 quota = A LOT MORE.
The exact same radioactive provision for H1 quota is also in Lieberman-Hagel amendment 1242.
This will sink both of them unless either there is some inside deal going on that we dont know, or they strike out the H1 issue from this on the floor of the senate at the last minute and be content with H1 quota of 180,000.
When Sanders got his amendment he actually was giving sops to the IEEE folks as he surely knew that he couldnot get the H1B numbers reduced. On the other hand note that Cantwell is from Washington (Microsoft's state) and has garnered support from Leahy, Cornyn and Hatch. So this amendment comes from both sides of the aisle and once the $5000 fee is in place for the H1B it is difficult for Durbin/Grassley and the rest to really argue otherwise at this point. Infact didn't Durbin et al. get some additional restrictions in place for H1-B's?
Lets hope for the best.....Should we be specifically targeting some Senators for phone calls about SA 1249?????

As we have been learning, majority of the American public (including your neighbors) associate immigration reform with illegal immigration. Now if you ask them politely and ask whether they support immigration for highly skilled/highly educated individuals (already in the US working), you will hear no protests.
So basically, it boils down to awareness. When we have people affected by retrogression, unaware of the issues, how can we expect a lawmaker to know the inner details?
Just contact the lawmaker's office for creating awareness. Pro/anti-immigration is an after-thought.

so i understand how the whole 7% thing works now in relation to the total visa's available....
but what i dont get it the fact that EB3 ROW was at Aug 02 in april this year,
then in May it moved to AUG 03, so people were clearly getting through the system....
then in June it moved to June 05 so again in that month people where getting processed, and moving through the system....
then the July fiaco, i guess because they were running tight for visa numbers...ok water under the bridge.....
But now the Oct bullitin which is the start of the new fiscal year puts us back to AUG 02 again........how does that work??? i dont get it. how can they suddenly be dealing with people from 02 when even in May it was up to AUG 03???
I would have thought that with the start of a new fisacl year there would be a full fresh batch of numbers, and people would get through a bit quicker for a least a couple of months...you would have thought that it would be current for the first month on the new allotment....wouldnt you???

There is much info ont this board that explains why this happened? It has been posted and debated in much much detail. It boilds down to, visa numbers are allocated to each quarter. The visa quota year ends in September, so the run up to this was the last quarter of the year. Under mounting pressure a combination of the Department of State and the USCIS didn't want to be accused of wasting visa numbers again, so they pushed dates REALLY far forward to make sure they wouldn't.
That drama is now over and we return to the normal state of affairs.
Just because you are a Brit born and bred, don't think you'll get your visa any faster. IF your occupation does qualify you for an EB3 (Bachelors degree or experience equivalency) and you aren't in the states now on any kind of temprorary visa. What I don't understand is, if you aren't in the US now - what employer would sponsor someone for a greencard that won't arrive for about 6 years?
