I am a US Citizen and will be filing a petition (i 130) to bring my mother over on a greencard.
Recently on her visit to the US on a visitor visa she was marked as NO AOS/COS/EOS on her I - 94
and she left by the date specified on her i - 94.
My question is will it have any effect on her GC petition and what is the current wait time for consular processing on an i-130 petition

Hi All
I have submitted my Indian passport for renewal at Houston Indian consulate via mail , it�s been close to a month I haven�t heard anything from consulate. I tried calling them up, no one attends the call.
Do you have any idea how can I speed up this process? Does personal visit to Houston consulate will help in speeding this up? Does passport submitted via mail can be handed over to me in person ?

The Department of Labor published a final rule, effective on June 29, 2009, that suspends the H-2A final rule published on December 18, 2009. DOL is republishing and reinstating regulations in place on January 16, 2009, for 9 months, after which the Department will either have engaged in further rulemaking or lift the suspension.

A friend of mine has submitted visa application fee and has made an appointment for visitor visa next week.
Can someone please tell if there is any other requirement of making a draft for some other fees during the Visa interview? (I am confused because a couple of years ago we used to submit one more bank draft during Visa interview)

Do we (parent) gets any benefits in terms of Visa status if you have child born in USA and you stay in US for certain years?
In the other word:
Once you have child born in USA is there any way to get green card based on your child citizenship?
Once the US citizen child is an adult (I think 21 years old), then s/he can sponsor the parents for green card.
Otherwise, no.

Hi,
I am on the 8th year of my H1B. I have an approved I140. There is a chance that I may have to leave my current job, and there will be a gap before I obtain another job. Two questions:
1. Can I stay in the US just on an approved I140 and no H1B?
2. I know I can get my H1b transferred. Can I instead leave my current job, be on I140 for some time, and apply for a new H1B for the new job, still continuing the 8th year?

I am working on L1 from Company A.
I have applied for L1 to H1 status for year 2008 from comany B. H1 got approved without COS. As COS not done, I continued working on L1 with company A. Now my L1 is getting expired on Aug 2010 and my L1 company want to extend L1.
While applying for my L1 extention, my H1 applival cause any problem.
Please help me to get more info on this. Please let me know if you need more details on this.

Hi,
My wife and I both have EAD and AP. My wife is derivative on my 485 application. I am using H1b for employment though, while my wife is using EAD for employment.
We are planning to travel to India. I am going to continue to use my H1 b as I am going for visa stamping on my trip to India. My wife will be using AP for reentry.
Questions:
1) Do you see any complications while reentering in this scenario either for me or for my wife since I will be using H1 visa and she will be using AP.
2) Does she need to carry her employment verification letter since she is derivative of my application? Can the IO at poe entry ask for her employment? What should she be saying her purpose of visit or any such questions? Would it be ok to mention 'pending AOS' as the status.

Today's news that Indiana Democratic Senator Evan Bayh will be retiring is probably bad news for much of the Democrat's legislative agenda. But when it comes to immigration, this is probably a good news day. Bayh's last vote on comprehensive immigration reform was a bad one. He voted with anti-immigration Senators to filibuster the 2007 version of comprehensive immigration reform and there is little reason to believe his vote in 2010 would be different. On the other hand, Senator Lugar, his Republican counterpart from Indiana, is a much more likely vote in favor reform. Bayh may feel freer to vote...
