She gave the choice to either send $20.00 MO or send an stamped envelope. I am contemplating on sending the $20.00 MO. Because I don't want them to tell me again that I have not sent the envelope, should I send one.

Now it's clear. You don't want people to drag you down, even when they have had gone through everything, Labor, I-140, been in the country for 10 years, etc. -- I thought you had a noble cause from the older posts, but apparently I was wrong.
This also started getting ridiculous. In my own post, and agreed by almost everyone else, I specially said to put on restrictions to those who can file AOS, e.g. with I-1140 approved, or with a PD older than a certain number of years. Where did you get the impression that every H1 can arrive this country and be on EAD in six months? Why did I found that the extreme generalization and scare tactic employed by you has an alarming resemblance to those from Lou Dobbs and Grassley?
And to answer your last question, even with a PD of 2007, I've been in the US for ten years, but could not file green card due to company bankruptcy, layoff, etc. and I am 90% certain you've been here shorter than I am. Then should give up your EAD till everyone who stays here longer than you does?

I am with you on the ludacris comparison brought by hydboy77. He keeps calling the EB3-EB2 porting line cutters as if these guys were paying 10,000 USD to buy substitute labors. Those Eb-3 folks have stood in line just like him, you and me and have an employer who values their contributions and has a position that has EB-2 requirements he can hire this EB-3 guy. Rather than thinking about the problem at its root, he keeps attacking people who port their PD and calls them line cutters. Bottome line: He has EB2 PD and worries that he will be screwed worse. While it is good to worry about the problem, it worries me when that worry comes at the expens of other's good. Jeez! we dont need anti's. We get dragged down by your own. Probably he does not know what USC code 1571 section 8 says even before AC21 came into picture. Congressional intent was to get a GC for every one with in 6 months. Infact he does not want every one to get EAD because he is scared. Doesn't a legislation that takes out the similar/same after 6 months and gets every one on to EAD is the best one as people will be able to demand what ever they want and put the kabosh on Grassley who keeps bitching that H1B's are paid peanuts?

His whole argument about the 06 guys getting GC ahead of 03/04 guys is entirely different. DOS had no other way to handle the inefficient USCIS other than forwarding dates ahead. I dont know whether he would have been happy, if DOS did not move dates and neither 04 guys and 06 guys got their GC, 20,000 visa numbers were wasted. I for one have a 02 PD and am happy for those who got out of the hell hole, regardless of their PD and at the same time I will keep pushing for USCIS to get better. I am actually seeing this effect in DOS VB this year. DOS is getting better at the game and moving the dates slowly and this summer EB-2 I/C will not go beyond Jun/Jul 05.

Who said that, GC is minimum in this country to live a normal life, with out it so many constraits as mentioned in our forum many times.
Few people are always with negitive attitude and lazy, do not even listen to them.

Hi,
I have a situation.I got a H1B transfer and i was working let it be z compsny.after few months i try to transfer to another company let it be X.before I start working over there in X company ,I gave my H1 for transfer.meanwhile i left the Z company and joined in new company let it be y.So in y company applied for H1B transfer meanwhile i got H1B approved from x company.But i havent work in X company even a single day.
I was working with Y company and I got regular paystubs everything with those things they applied for H1b transfer in my Y company.after few days we got a query that some evidence required .we provide the evidence also.now the case statues is "Evidence Received Case Processing Resumed".
and its taking time .Is there any problem .Will the case will be approved?

IV is more than a website. We are trying to build a grassroots organization. Things are taking place offline as well.
It takes time to build the base. Strengthening the state chapters is one of the best thing we can do. Our first chapter meeting was very small as well but we will build from there. More members are forthcoming to meet lawmakers now.

I am seriously considering this option. I have over 6 years experience as Manager in two large Indian IT companies (part of which is in L1A visa). However, I have detailed experience letter for about 2.5 years. The other company (through which I came on L1A earlier) does not give detailed experience letter per their policy. They gave a summary letter with start date-end date, designation and basic salary. I can get maximum point with 4 years experience.
Does anyone know if Canadian Immigration accept secondary evidence like coworkers letter and/or my job description as mentioned in the L1 petition by that company.
Also, does anyone know how much prep is required for IELTS ?

I think that going back to your home country ONLY because you feel overwhelmed by the delays in GC processing/retrogerssion (assuming you are quite content in your job and standard of living) is not a good idea. Especially true in the event that you and your family experience difficulties in adjusting professionally and socially after returning back. Chances are you might soon get a feeling of having taken a wrong decision in the heat of the moment, especially if the guys who stay back and ride this retrogression storm see some relief while you are still trying to adjust to the changed environment of your home country. You may even get tempted to come back and give the GC thing another shot but then you have to start at square one again.
Going back to home country only because of the shortcomings of GC process is like deciding to take a sanyas because you are tired of dealing with social issues. I belive a decision to renounce something should only come from a position of strength. A true jogi is one who understands the triviality of society and decides to rise above it...not the one who denouces it because he can't deal with it.
As the saying goes..its darkest before the dawn...I truely hope this is the case for all of us here...
We all know its not an easy 1-2-3 to happen in a jiffy for something to be debated in the Capitol hill...signed by the President..and becoming a law, against all odds of gas hikes,natural disasters,anti immigration...Immigration stands on a scale of 1 to 10,maybe number 9 or 10.

Really an interesting issue to talk about. I came to this site via google search. I am in the same boat. I am living in country for 14 years (F1 and now H1) with SSN. My wife never worked here; so she has H4. We have a daughter born here with SSN. We could not get this "stimulus rebate" because we filed "married filing jointly". I understand from IRS site that if you filed "married filing separately" you would get the benefit and you can later on amend your filing as "married filing jointly" (04/14/08). This may be beneficial if you "itemize" your deductions. You will still qualify for excemptions. But, if you do not itemize your deductions, your standard deduction will be halved if you file "married filing separately".
We filed married filing joingly and received our tax returns and no stimulus rebate. Can we re-file our tax return by filing separately this year (i.e. extension/amendment within 3 months?) Has anyone done this? Please let me know.

I�ve been laid off as of Friday last week.
My employer started laying off people an year ago and there were too many cycles so far. I was immune to all those layoffs until Friday. They eliminated everybody in my team, 15 people in total.
I am in the final stage of my GC and I have 2 year EAD. My H1 is expiring in March and my (ex) employer already paid my Attorney for the 3 year extension. They have decided to extend my H1 and paid for the expenses. But in the mean time, they were forced by the investors to show profitability and hence the layoffs.
My (ex) employer is based in Massachusetts and my Labor Certification was done from this location.
I have received job offers from some of my employer�s clients. However, they are based in other States (CO, OH & WA for instance) and they might not be able to do my H1. One of them is interested in hiring me on a contract basis, since they had frozen new hiring.
Is taking a job outside of Massachusetts impact my pending I-485? or Will it violate my Labor Certification conditions? I couldn�t find an answer for this anywhere.
Also, can I take contract jobs for the time being?
I sent out an email to my Attorney with all these questions. But, he is not available until Tuesday next week.
Please post your answers, comments and suggestions.

I guess it depends... I would prefer to slog with weather in Canada for 3 years and get citizenship instead of stuggling for 4-5 years with desi consultanting company to get GC. My sixth year is about to start in december 2009 and employer has told that they will not sponsor GC. I am planning to take citizen ship from Canada and then move back to India. That way, anytime I want to come back to US/Canada doors will be open. I guess, there is no right or wrong answer, its a matter of choice.
