Yes, that is an issue. You will need to get an affidavit. The affidavit can be faxed or scan+emailed over to you.

Well, I just made my third call and the lady sounded quite confident that applications that have been received and are in processing are not affected by this and it's only NEW applications that would be coming in after July 2 that are affected. I understand what you're saying that they don't assign it but I have read before that they "assume" each application qualifies unless they eventually figure out otherwise. And now I am making my own assumption that if they assume it qualifies then it's assumed a visa is indirectly assigned? Wait, I'm confused:D.
I've noticed that it's hard to get someone who can sound like they are really sure of the information they're giving you. I wonder if they're reading from something or just guessing sometimes. i shouldn't have to use the internet to get my information, they should be the #1 information center, and they can't even do that.:(

EB 3 India has become joke when u look over all the previous patterns. :mad:
sagar_nyc, agreed. EB3 is a joke and even worst I have become a joker in front of all my friends who applied in EB2 cheating the system. Funny is, experience wise, I am well ahead of all those making fun of me but...:-(

That is right. But same country quota is there in EB system also. So in point system also 80% of people will get same quality of people as current system. But advantage is process delay will be eliminated.
Right now, in the EB based system, the employer picks the applicant, not the Federal Government. Also, under the current system, even if the country is limited by quota, it is a soft quota. No matter how you see it, the current system attracts the best and brightest and rewards only only those who are physically in this country with the GC (EB based). how can that be compared to the merit based system which you claim would attract the 80%? Any tom/dick or harry can apply from any country and get thru.

I know the reason for issuing H4 visa is to be with the primary H1B. Therefore i can understand why some people will say that is why H4 are not allowed to work. But the reality is that for all other employement based visas or immigrant visas there is only 1 primary applicant. Like when you get AD after 485 stage, your spouse also gets AD. Also L2 visa holders who are dependents of L1 visa holders get work permits. Its only the H4 visa holder who do not get work permits. It beats me why in the world law makers did not allow work permits for H4 when they allow work permits for L2 and give EAD cars for spouses during 485 stage.

Ask yourself this question: (assume that you are american born person and are advisor to one of the campaigns): What will help you politically? Supporting skilled EB immigrants (140k per year, who will not be able to vote for at least next five years) or FB immigrants (860k per year, who may also not be able to vote for next five years) or no immigrants (join the part of Loo Doggs and count on may be 1-2 percent of population who may support them which would be 3-6 million votes).
In nutshell, from the perspecitive of politicians, it is never a good deal to support EB immigration; the only incentive for them is the money they get from big companies like microsoft, IBM, google etc. And this is not enough to land us anywhere. Only a very few politician (like sen Lofgren) work for their principles, rest is all vote bank; that's why horses are more important than us.
I am a little bit bitter here, but it is time to understand this reality and consider our strategy accordingly; espeicially for the possible CIR next year.

So in this case if I work for EMP A and apply for a h1b thru EMP B as soon as the MEP B's petition is approved I lose the approved peition with EMP A ??? I know the answer but want to see your take....... (No. as your scenario is quote, Emp B applied for a H1B (assume new filing). Emp A H1B is also valid as long as one of them is your primary sponsor with full time job. If Emp B transfers an approved H1B for Emp A, then Emp A as a sponsor cease to exist. The bottom line - there are visas available in EB2 ROW and EB1 categories (which are current, meaning, undersubscribed), that are getting redistributed to EB3 ROW. This is why EB3 in total is using more than its share of 140,000 EBs. In fact, I believe the dates will be moving pretty fast on EB3 ROW, it will probably get all current in a couple of years.

I did sometime back.
Given thanksgiving is barely a week away, we can be certain of the usual platitudes directed at immigrants - this is a good time to remind the average American how far they have strayed from their roots and forgotten the true .
I agree with you 100%...but before we do that we should clean up our forums so that there are no 'un mindful' comments...from our members that can embarass our citizen friends. I have seen those unthoughtful comments before and they will not do good for our cause...
I remember pointing this site to a colleague of mine and he came back with a 'stupid' comments posted by some one and I had to do a lot of explaining...

How about having a monthy/semi monthly conf call (similar to Rajiv Khanna's call), that will probably help in making every one aware of the structure and heirarchy in IV. I am sure a lot of us want to do some thing...posting 100 times to get noticed can't really be the best way to manage the ideas.
I got a feeling that some members feel that IV run a secret community with-in IV (I am not sure how many watched the movie "The Stepford Wives" ).
I think that core members and volunters knows strategy and action plan well before others. I think there would be hierarchy within that also.
I dont see anything wrong in that.
Here I think what goes on internally.. If you are more active in the threads you would sure get a message from IV moderators about ur willingness to volunteer. IV core seriously does not have the ability to read the psyches of each individaul member and invite them int to the secret soceity(?). Only possible way to know for them is how much active you are for a while. i dont think there are any specific paramters for that , it is a matter IV core getting convinced that u r serious enough. Not a day or two.. How long .. and how serious you are with ur ideas...
About funds .. none of the organizations declare their monetory dealings openly. There is a youtube video by logiclife on this. see it if u have not laready seen it.
